1. Introduction
These Terms of Service ("Terms") govern your use of the Inspecto website (inspecto.com.au) and our pallet rack inspection services. By accessing our website or booking our services, you agree to be bound by these Terms.
Inspect (ABN 56 197 066 721), based in Toowoomba, Queensland, provides professional pallet rack inspection services in accordance with Australian Standard AS 4084:2023.
2. Definitions
- "We", "Us", "Our" refers to Inspecto.
- "You", "Your" refers to the customer or website visitor.
- "Services" refers to pallet rack inspections and related consulting services.
- "Inspection" refers to the assessment of pallet racking systems for safety and compliance.
- "Report" refers to the documentation provided following an inspection.
- "AS 4084:2023" refers to the Australian Standard for Steel Storage Racking.
3. Our Services
Inspecto provides:
- Independent pallet rack safety inspections
- Compliance assessments to AS 4084:2023
- Detailed inspection reports with findings
- Professional advice on racking safety
- Damage identification and classification (Red/Orange/Green)
- Photo documentation of inspected equipment
Note: We do not perform repairs or modifications to racking systems. We provide inspection and reporting services only.
4. Booking and Appointments
4.1 Online Booking: Inspections can be booked through our online booking system or by contacting us directly.
4.2 Confirmation: Bookings are confirmed upon receipt of payment and availability confirmation.
4.3 Cancellations: Cancellations must be made at least 24 hours before the scheduled inspection time. Refunds are processed in accordance with our Refund Policy.
4.4 Rescheduling: We understand that circumstances change. You may reschedule your inspection with at least 24 hours notice at no additional cost.
4.5 Access Requirements: You must ensure safe access to the racking systems for our inspector, including providing necessary safety equipment and site access.
5. Pricing and Payment
5.1 Pricing: All prices are displayed in Australian Dollars (AUD) and include GST where applicable. Prices are subject to change without notice.
5.2 Payment: Payment is required at the time of booking through our secure payment gateway (Square). We accept major credit cards.
5.3 Invoices: For business customers, we can provide tax invoices upon request. Please provide your ABN for B2B invoicing.
5.4 Travel Fees: Inspections outside our standard service area (Toowoomba, Brisbane, and SE Queensland) may incur additional travel charges. These will be quoted upfront.
6. Service Area
We primarily service Toowoomba, Brisbane, and South East Queensland. Inspections outside this area may be arranged by special request and will incur additional travel fees.
7. Inspection Process
7.1 Standards Compliance: All inspections are conducted in accordance with AS 4084:2023 - Steel Storage Racking.
7.2 Visual Inspection: Our inspections are visual assessments from ground level unless otherwise agreed. We do not dismantle racking or use elevated work platforms unless specifically requested and quoted.
7.3 Classification: Defects are classified as:
- Red (Critical) - Immediate action required
- Orange (Monitor) - Attention needed soon
- Green (Pass) - Acceptable condition
7.4 Limitations: Inspections are limited to accessible areas. Hidden damage or defects behind stored goods may not be visible.
8. Inspection Reports
8.1 Report Delivery: Reports are delivered digitally within 3-5 business days of the inspection.
8.2 Report Content: Reports include:
- Inspection summary and site details
- Detailed findings with photos
- Classification of defects
- Compliance statements
- Inspector details and certification
8.3 Report Validity: Reports represent the condition of the racking at the time of inspection only. Regular inspections are required (AS 4084:2023 recommends at least every 12 months).
9. Warranties and Disclaimers
9.1 Professional Standards: We warrant that our services will be performed by qualified inspectors in accordance with AS 4084:2023 and industry best practices.
9.2 Important Disclaimer:
Our inspection reports are advisory only and do not guarantee the structural integrity or safety of your racking systems. The responsibility for maintaining safe warehouse operations remains with the facility owner/manager.
We recommend that any identified defects be reviewed and addressed by qualified engineers or racking manufacturers before returning racking to service.
9.3 No Repair Warranty: As we do not perform repairs or modifications, we cannot warrant the quality or safety of any remediation work performed by third parties.
9.4 Limitation of Liability:
To the maximum extent permitted by law:
- Our liability for any claim is limited to the cost of the inspection service paid
- We are not liable for indirect, incidental, or consequential damages
- We are not liable for third-party actions taken based on our reports
10. Consumer Guarantees (ACL)
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to:
- Services being provided with due care and skill
- Services being fit for purpose
- Services being completed within a reasonable time
Nothing in these Terms restricts your rights under the Australian Consumer Law.
11. Refund Policy
11.1 Cancellation Before Inspection: Full refunds are provided for cancellations made at least 24 hours before the scheduled inspection.
11.2 Late Cancellation: Cancellations made less than 24 hours before the scheduled inspection time will incur a 50% cancellation fee to cover preparation and scheduling costs. The remaining 50% will be refunded to your original payment method within 5-10 business days.
11.3 No-Show: If you do not attend the scheduled inspection and do not provide notice of cancellation, or if our inspector cannot access the site due to your failure to provide agreed access, you will be charged the full inspection fee. No refund will be issued for no-shows where we have incurred costs to attend your site.
11.4 Service Issues: If you believe our service did not meet professional standards, please contact us within 7 days of the inspection. We will review and may offer a refund or re-inspection.
11.5 Refund Process: Refunds are processed to the original payment method within 5-10 business days.
12. Site Safety and Access
12.1 Safety Requirements: You are responsible for ensuring the inspection site is safe for our inspector to access.
12.2 Access Clearance: You must provide:
- Safe access to all racking systems
- Appropriate personal protective equipment (PPE) where required
- Site induction or safety briefing if required
- Escort or site contact if required by your site rules
12.3 Unsafe Situations: Our inspector may refuse to inspect or stop an inspection if site conditions are unsafe. In such cases, a partial refund may be offered at our discretion.
13. Privacy and Data
Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
14. Intellectual Property
14.1 Our Content: All content on our website (text, images, logos) is owned by Inspecto or licensed to us. You may not copy, reproduce, or distribute this content without permission.
14.2 Your Inspection Reports: Inspection reports provided to you are for your internal use only. You may share them with relevant parties (insurers, WorkSafe, racking manufacturers) as needed.
14.3 Photos: Photos taken during inspections become part of the report. These may be used by you and relevant parties for compliance and safety purposes.
15. Termination
We may suspend or terminate your access to our services if you breach these Terms or engage in fraudulent activity. We will provide notice of termination where possible.
16. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes will be resolved in the courts of Queensland.
17. Changes to These Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated date. For existing customers with active service agreements or bookings, material changes affecting your rights or obligations will be communicated directly via email at least 14 days before taking effect. Continued use of our services after receiving notice of material changes constitutes acceptance of the updated Terms.
